Terms of Service

By accessing or using the 2010 Nails & Spa website (the "Site") or booking any of our services, you ("you" or "Customer") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please do not use our Site or services.

These Terms constitute a legally binding agreement between you and 2010 Nails & Spa, a nail salon and spa operating in Florissant, Missouri. We reserve the right to update these Terms at any time; changes become effective upon posting to the Site.

2010 Nails & Spa provides nail care, spa, and related beauty services at our physical location. Our website allows you to view service information, read promotions, and submit appointment booking requests.

Submission of an online booking form does not guarantee a confirmed appointment. A booking is confirmed only when you receive a direct confirmation from us via phone or email. We reserve the right to decline or reschedule any booking at our discretion.

Services, pricing, and availability are subject to change without notice. We endeavor to keep the Site accurate but do not warrant that all information is complete or current.

We ask that you notify us at least 24 hours in advance if you need to cancel or reschedule your appointment. This allows us to accommodate other customers.

Repeated no-shows or late cancellations (less than 24 hours' notice) may result in a cancellation fee or refusal of future bookings. We will make reasonable efforts to contact you before imposing such measures.

We are not responsible for delays or cancellations caused by circumstances beyond our control, including severe weather, utility outages, or other force majeure events.

Payment for services is due at the time of service at our physical location. We accept cash and major credit and debit cards. Accepted payment methods are displayed at our front desk and may be updated from time to time.

All prices are listed in US Dollars and are subject to applicable Missouri state and local sales tax. Gratuities are not included in service prices and are at your discretion.

For the safety and comfort of all guests and staff, we ask that you:

• Inform us of any skin conditions, allergies, sensitivities, or health concerns that may affect the services you receive. We reserve the right to decline service if we believe it may pose a risk to you or our staff.
• Not bring contagious illnesses (including active nail fungal infections, open sores, or communicable diseases) into our salon.
• Treat our staff and other guests with respect. We reserve the right to refuse service to any individual who is disruptive, abusive, or threatening.
• Supervise children while on the premises. We are not responsible for the safety of unattended children.

All content on the Site — including text, graphics, logos, images, and software — is the property of 2010 Nails & Spa or its content suppliers and is protected by applicable United States copyright, trademark, and other intellectual property laws.

You may view, print, or download content from the Site solely for your own personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without our prior written consent.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Site.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 2010 NAILS & SPA AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE THIRTY (30) DAYS PRECEDING THE CLAIM.

Some states, including Missouri, do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless 2010 Nails & Spa and its owners, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site or our services; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party rights.

These Terms are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in St. Louis County, Missouri, and you consent to personal jurisdiction in those courts.

Before initiating formal legal proceedings, we encourage you to contact us directly to attempt to resolve any dispute informally. We will make a good-faith effort to address your concerns within a reasonable time.

The Site may contain links to third-party websites for your convenience. We do not control, endorse, or assume responsibility for the content or practices of any third-party site. Visiting linked sites is at your own risk, and we encourage you to review the privacy policies and terms of service of any site you visit.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 2010 Nails & Spa regarding your use of the Site and supersede all prior agreements, understandings, or representations relating to the same subject matter.
